The name, delivery address and contact details given during checkout apply.
2. Subject of the agreement
This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the product ordered electronically by the BUYER at https://mediha.art, in accordance with Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation.
3. The product
The type, quantity, model, sale price and payment method of the product are stated in the order summary and in the order confirmation e-mail; that information forms an integral part of this agreement.
The works sold in this store are handmade and mostly one of a kind. Small differences in colour, texture and size may occur between copies of the same model; such differences are not considered defects.
4. General provisions
- The BUYER confirms having read and understood the preliminary information about the product's essential features, sale price, payment method and delivery, and having given the required confirmation electronically.
- The product is delivered to the address given by the BUYER through a courier company within the period following the order and completed payment, and in any case within the statutory 30 days.
- If the product is to be delivered to someone other than the BUYER, the SELLER is not responsible for that person refusing delivery.
- The SELLER is not responsible for failed delivery caused by problems the courier encounters while delivering to the BUYER.
- The BUYER must inspect the product on delivery, refuse it if there is damage caused in transit, and have the courier issue a damage report.
5. Right of withdrawal
The BUYER may withdraw from this agreement within 14 (fourteen) days of the product being delivered to them or to the person at the address they gave, without giving any reason and without paying any penalty.
Notice of withdrawal must be sent in writing to info@mediha.art within that period. The price is refunded to the BUYER through the payment method used, within 10 days of the notice reaching the SELLER.
To exercise the right of withdrawal the product must be returned unused, in resaleable condition and with its original packaging if any.
Where the right of withdrawal does not apply
Under article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for:
- Products prepared to the BUYER's own specifications or personal needs — commissioned and personalised work.
- Products whose packaging has been opened and whose return is unsuitable for health or hygiene reasons.
- Products that by their nature cannot be returned, that deteriorate quickly or whose expiry date may pass.
6. Default and its consequences
If the BUYER defaults on a credit card transaction, they accept that they will pay interest under the credit card agreement with their issuing bank and will be liable to that bank, which may pursue legal remedies.
7. Competent authority
For disputes arising from this agreement, the Consumer Arbitration Committees at the BUYER's or SELLER's place of residence are competent within the monetary limits announced by the Ministry of Trade, and the Consumer Courts above those limits.
8. Entry into force
By confirming the order electronically the BUYER accepts all terms of this agreement. The agreement enters into force when the SELLER confirms the order.
